Article 1347

All things which are not outside the commerce of men, including future things, may be the object of a contract. All rights which are not intransmissible may also be the object of contracts.

No contract may be entered into upon future inheritance except in cases expressly authorized by law.

All services which are not contrary to law, morals, good customs, public order or public policy may likewise be the object of a contract.

Lahat ng bagay na wala sa labas ng commerce ng tao, kasama na ang mga bagay sa hinaharap, ay maaring ang bagay sa kontrata. Lahat ng karapatan na hindi intransmissible ay maari rin maging bagay sa kontrata.

Walang kontrata ang maaring ipasok sa hinaharap na pagmamana maliban kung pinahihintulutan ng batas.

Lahat ng serbisyo na hindi labag sa batas, moralidad, mabuting kaugalian, pang publikong kaayusan o pang publikong panuntunan ay maaring maging katulad ng bagay sa kontrata.

*The Object of the Contract is its subject matter and it can be a;

  1. thing
  2. right
  3. service which arising from the contract

These are the exceptions to the rule that future inheritance cannot be the subject of a contract:

  1. In case of marriage settlements, future inheritance may be the object of donation.
  2. In case of partition of property inter vivos made by the deceased himself as long as no legitime is impaired.
